1. Definitions

We reserve the right to suspend or terminate any account that violates these Terms or engages in fraudulent, abusive, or illegal activity.

4. User Content and Conduct

4.1 Ownership of Content

You retain all intellectual property rights to the Content you post. You are solely responsible for ensuring that you own all rights to your Content or have obtained all necessary licenses and permissions.

4.2 License to the Site

By posting Content on Earn Tech BD, you grant us a worldwide, non-exclusive, royalty-free, transferable, sub-licensable license to use, reproduce, distribute, display, and perform your Content in connection with operating, promoting, and improving the Site. This license ends when you delete your Content or account, except to the extent the Content has been shared with others and they have not deleted it.

4.3 Prohibited Content

You agree not to post, upload, or share any Content that:

• Infringes any copyright, trademark, patent, trade secret, or other proprietary right.
• Contains adult, sexually explicit, or obscene material.
• Promotes violence, hatred, discrimination, or harassment.
• Includes malware, viruses, or any harmful code.
• Violates the Google AdSense Program Policies (including but not limited to copyrighted material, illegal content, dangerous or derogatory content, or misleading practices).
• Is spam, unsolicited advertising, or unrelated promotional material.
• Impersonates any person or entity or misrepresents your affiliation.

We do not actively monitor all Content but reserve the right to remove any Content that violates these Terms, with or without notice, and to terminate the responsible account.

5. Our Content and Intellectual Property

The Site itself, including its design, logos, trademarks, text, graphics, and software (excluding User Content), is owned by Earn Tech BD or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works of the Site without our prior written consent.

6. Earning Program

6.1 Overview

Earn Tech BD offers a program through which registered users can earn income based on the performance of their posted Content (e.g., views, engagement, ad revenue sharing). Specific earning rules, rates, thresholds, and payout methods are detailed in a separate Earning Guidelines page, which is incorporated into these Terms by reference.

6.2 Eligibility and Compliance

To qualify for earnings, your Content must:

• Be completely original and created by you.
• Comply fully with these Terms and the Earning Guidelines.
• Not contain any material that would violate Google AdSense policies (e.g., no adult content, no copyrighted third-party material).

6.3 Payment

We process payouts on a schedule and via methods announced on the Site. You are responsible for any taxes related to income earned. We reserve the right to withhold or reverse earnings if we determine that Content violates these Terms, or if earnings are generated through fraudulent, artificial, or invalid activity (e.g., bots, click farms, incentivized clicks).

6.4 No Guarantee

We make no guarantees regarding the amount of income you will earn. Participation in the Earning Program is at our sole discretion and may be modified or discontinued with prior notice.

7. Copyright Infringement (DMCA Notice)

We respect the intellectual property of others. If you believe any Content on the Site infringes your copyright, please send a written notification containing the following:

• An electronic or physical signature of the copyright owner or authorized agent.
• A description of the copyrighted work claimed to have been infringed.
• The URL or location of the infringing material on our Site.
• Your contact information (name, address, email, phone number).
• A statement that you have a good faith belief that the use is not authorized by the copyright owner.
• A statement, under penalty of perjury, that the information in the notification is accurate.

Upon receipt of a valid notice, we will promptly remove or disable access to the allegedly infringing Content and terminate the accounts of repeat infringers in appropriate circumstances.

8. Third-Party Links and Services

We assume no responsibility for the content, privacy policies, or practices of any third-party sites. You access such links at your own risk, and we encourage you to review the terms and privacy policies of every site you visit.

9. Disclaimer of Warranties

THE SITE AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT WILL BE ACCURATE OR RELIABLE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EARN TECH BD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, INCLUDING LOST PROFITS, DATA LOSS, OR DAMAGE TO REPUTATION, EVEN IF ADVISED OF THE POSSIBILITY. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE EARNED THROUGH THE EARNING PROGRAM IN THE SIX MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to defend, indemnify, and hold harmless Earn Tech BD and its affiliates from and against any claims, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your Content.
• Your violation of these Terms.
• Your violation of any third-party right, including intellectual property or privacy rights.
• Any fraudulent or illegal activity conducted through your account.

12. Termination

We may terminate or suspend your account and access to the Site at any time, with or without cause, and with or without notice, effective immediately. Upon termination, your right to use the Site ceases, and any accrued but unpaid earnings (if legitimate and compliant) will be paid in accordance with the Earning Guidelines. Provisions of these Terms that by their nature should survive termination (e.g., ownership, disclaimers, indemnification) shall survive.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Bangladesh, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Site shall first be attempted to be resolved through informal negotiation. If unsuccessful, the dispute shall be submitted to the exclusive jurisdiction of the courts located in Dhaka, Bangladesh.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we do, we will update the "Effective Date" at the top of this page and, for material changes, provide a notice on the Site or via email. Your continued use of the Site after such changes indicates your acceptance of the revised Terms.

15. Miscellaneous

• Entire Agreement: These Terms, together with our Privacy Policy and any Earning Guidelines, constitute the entire agreement between you and Earn Tech BD.
• Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.
• No Waiver: Our failure to enforce any right does not constitute a waiver of that right.
